Affiliate Program Terms

These Affiliate Program Terms (the "Terms") govern participation in the MindSwap Affiliate Program (the "Program"). They explain participant and company rights, obligations, and the process for earning rewards.

By participating in the MindSwap Affiliate Program and earning as an Affiliate, you ("Affiliate", "you", "your") agree to comply with these Terms and any amendments, as well as the MindSwap Terms of Service, Privacy Policy, Security Policy, and Cookie Policy, which form part of this Agreement.

If you do not agree to any part of these Terms, you must not participate in or access the MindSwap Affiliate Program.

1. Definitions

1.1 "MindSwap Affiliate Program", "Affiliate Program", and "Program" refer to the affiliate program offered by MindSwap on the MindSwap website.
1.2 "MindSwap" ("Website", "we", "us", and "our") refers to the MindSwap platform at mindswap.io and any associated applications.
1.3 "Affiliate" ("you", "your") means the individual or entity participating in the MindSwap Affiliate Program under these Terms.
1.4 "Profile" means the account held in the Affiliate's name with MindSwap.
1.5 "Referral" means every new client attracted by a Partner to use the MindSwap API.
1.6 "API" means the MindSwap API used by the Partner for automated cryptocurrency exchanges.
1.7 "Affiliate Link" means a unique link containing an Affiliate Code that the Affiliate uses in email invitations, social media, or other promotional channels to direct Referrals to the exchange form through MindSwap's API.
1.8 "Affiliate Code" means a unique code used to identify a Partner.
1.9 "Affiliate Website" means the Partner's website or application that provides MindSwap services, tools, or promotions through which Referrals are attracted.
1.10 "Services" means any MindSwap services offered for cryptocurrency exchange that will be promoted by the Affiliate.
1.11 "Tools" refers to the exchange widget, exchange button, and referral link offered by MindSwap that can be integrated into the Affiliate Website to enable Referrals to use the Services.
1.12 "Commission" means the fee payable by MindSwap to the Affiliate based on Qualified Transactions made by a Referral.

2. Enrollment in the Affiliate Program

2.1 To enroll in the Program, the Affiliate must register an account at mindswap.io. The Affiliate is solely responsible for safeguarding their email and password.
2.2 After signup, MindSwap automatically generates a unique Affiliate Link and provides it to the Affiliate. There is no application or approval process for the Program, and every registered user may participate.
2.3 The Affiliate can create up to five (5) different Affiliate Codes and may delete unused ones.
2.4 After an Affiliate Code is removed, it cannot be restored. Funds from clicks and completed exchanges tied to the deleted link will no longer be credited.
2.5 To use the API Affiliate Program, the Affiliate must contact us by email at [email protected] and provide detailed information about how the API will be used in their project.
2.6 A participant may have only one active account. Using multiple accounts, directly or via third parties, to gain advantages, bypass restrictions, or abuse the Program is prohibited. If a violation is detected, MindSwap may cancel rewards and block associated accounts.

3. Affiliate Rights and Obligations

3.1 By participating in the Program, the Affiliate represents and warrants that:
  • They have read and understood these Terms.
  • All information submitted to MindSwap is truthful, accurate, and up to date, and they will maintain its accuracy.
  • They have full legal capacity to enter into binding agreements.
  • Their Referrals agree to MindSwap Terms of Service.
  • They will not reverse engineer, decompile, or disassemble MindSwap Tools or software.
  • Participation does not conflict with applicable laws, regulations, licenses, or permits.
  • They are responsible for maintaining and updating their website or application.
  • They will inform MindSwap about errors or difficulties and typical symptoms of such issues.
  • Participation does not violate any agreement to which they are a party.
  • They understand the website may experience downtime, delays, or network-related issues outside MindSwap control.
3.2 The Affiliate may promote MindSwap Services only in accordance with these Terms and any other terms set by MindSwap during the term of this Agreement.
3.3 The rights granted to the Affiliate are non-exclusive. Nothing in these Terms prevents MindSwap from entering into other affiliate or third-party agreements or from promoting its own Services.
3.4 The Affiliate is responsible for its own advertising and promotional expenses, unless otherwise agreed in writing by MindSwap.

4. Affiliate Restrictions

4.1 By enrolling in the Program, you agree not to engage in activities that MindSwap determines to be harmful to its customers, employees, operations, or reputation.
4.2 Forbidden activities include:
  • Using referral links for your own asset exchanges.
  • Promoting MindSwap services to anyone whose registration or use would violate MindSwap Terms of Service.
  • Registering or purchasing domains that use MindSwap intellectual property, or copying/imitating the MindSwap website.
  • Using cookie-stuffing, click generators, or artificial traffic to set tracking cookies without a Referral's action.
  • Using paid search ads that include the MindSwap brand name or domain (including variants or misspellings).
  • Making promises, guarantees, or financial advice on behalf of MindSwap.
  • Misrepresenting your relationship with MindSwap or implying agency or authority without permission.
  • Making false, misleading, or incompatible claims about MindSwap.
  • Engaging in illegal activities, including trafficking, violence, financial crimes, smuggling, cybercrime, or corruption.
  • Sending obscene, defamatory, or rights-violating messages to MindSwap services, or promoting hate or discrimination.
  • Using Affiliate Links to create personal schemes with Referrals, such as interest payments or bonus promises.
  • Posting Affiliate links on official MindSwap platforms, chats, forums, or social channels.
  • Publishing affiliate content that installs spyware, malware, or unauthorized software on user devices.
4.3 MindSwap may request detailed information about how Referrals are attracted at any time.
4.4 MindSwap may exclude a Partner from the Program for violations, aggressive behavior, threats, or refusal to provide requested information. Exclusion may include blocking API keys and prohibiting profit withdrawals.
4.5 MindSwap may exclude a Partner from the Program at its sole discretion without prior notice and without disclosing the verification methods or criteria used.

5. Using the Affiliate Program with the API for Commercial Purposes

5.1 Partners may use the API with the Affiliate Program to earn 40% of MindSwap revenue from each Qualified Transaction.
5.2 To use the Affiliate Program with the API, you must go to API Management in your account, select "For commercial use with the affiliate program" when generating a new key, and submit a request with a link to your Service and activity description. Withdrawals are available only after approval.
5.3 By using the Affiliate Program for commercial purposes, you confirm that all orders will be paid for by your customers.
5.4 You must display a clear notice that exchanges are performed using MindSwap in accordance with its rules. Use the following text: "Exchange services provided by MindSwap. Creating an order confirms your agreement with the MindSwap rules." The notice must be prominent and easy to read.

6. Affiliate Earnings

6.1 The Affiliate is entitled to a commission equal to 40% of MindSwap income from all Qualified Transactions.
6.2 To withdraw funds, the Affiliate must submit a request in the Withdrawal Profile, which must be reviewed and approved by MindSwap within three (3) days.
6.3 The minimum withdrawal amount is 0.001 BTC.

7. General

7.1 These Terms are an integral part of the MindSwap Terms of Use and Partner agreement.
