API Terms of Use

By accessing or using the MindSwap API, you agree to these API Terms of Use (the "API Terms"). By installing, downloading, copying, or otherwise using the MindSwap API, you accept the Terms below.

These API Terms form an Agreement between you (the individual or entity you represent, referred to as "you", "your", "Partner", or "API User") and MindSwap ("we", "us"). They govern use of the public MindSwap API ("MindSwap API", "our API"). If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you do not have such authority or do not agree to this Agreement, you may not use the MindSwap API. This Agreement is effective on the first date you use the MindSwap API.

1. Definitions

1.1 "API" means a software application, website, interface, or any other means you use that can be integrated with the Partner's or API User's software.
1.2 "Agreement" means the terms and obligations set forth in these API Terms that MindSwap and the Partner agree to follow. The Agreement comes into force on the first date the Partner uses the MindSwap API.
1.3 "API Credentials" are the credentials that allow you to make authenticated requests to the MindSwap API.
1.4 "API User" means a MindSwap client using our API for personal use.
1.5 "Partner" means you or the company you represent in a professional relationship with MindSwap, using the API for commercial purposes.
1.6 "Partner Service" means a Partner's website, mobile application, or bot that integrates and uses our API.
1.7 "Referral" means a Partner's client who uses their Service.
1.8 "Developer Tools" means resources and tools that help develop, test, debug, and monitor services using the MindSwap API, including:
  • API documentation describing methods, parameters, example requests, and responses.
  • SDKs (Software Development Kits) with libraries, tools, and samples for easier integration.
  • Authentication and authorization tools for managing API security, including access tokens and keys.
1.9 "Terms of Service" means the MindSwap Terms of Service, available at https://mindswap.io/terms, which may be updated from time to time.
1.10 Unless otherwise stated in these API Terms, all definitions should be understood as provided in the MindSwap Terms of Service.

2. Updates to the API Terms of Use and Developer Tools

2.1 We may update the API Terms at any time as MindSwap or the Developer Tools evolve or as new industry trends affect our Agreement with you.
2.2 MindSwap may, at its sole discretion, support or modify the Developer Tools and may discontinue that support without notice. We may change, suspend, or discontinue all or part of the Developer Tools at any time. We do not guarantee backwards compatibility for future versions.
2.3 To stay current, review the date listed at the top of these API Terms. It is your responsibility to track updates to the API Terms and Developer Tools.

3. Licensed Use of the MindSwap API

3.1 Before accessing the MindSwap API and on an ongoing basis, you represent, warrant, and agree that you will comply with the MindSwap Terms of Service at https://mindswap.io/terms.
3.2 As between MindSwap and you, the Developer Tools, the MindSwap name and logo, and all associated intellectual property are and will remain the exclusive property of MindSwap.
3.3 Subject to these API Terms, MindSwap grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use and integrate the Developer Tools into your Service so it can interact directly with MindSwap services. Any violation of these API Terms immediately terminates your license.
3.4 Any cryptocurrency exchange performed through the MindSwap API is subject to the MindSwap Terms of Service at https://mindswap.io/terms.
3.5 You represent and agree that you will not violate any laws, contracts, or third-party rights, or commit torts by accessing our API. You are solely responsible for your actions or inactions while using our API.
3.6 When using the MindSwap API, you agree and will ensure that your employees, agents, and service providers:
  • Use the API only to develop, operate, and distribute the services you provide.
  • Limit disclosure of API Credentials to personnel who need access and are bound by confidentiality obligations.
  • Do not modify, translate, reverse engineer, decompile, disassemble, or create derivative works of the API, data, or services except where prohibited by applicable law.
  • Do not access our API or documentation to copy MindSwap or compete with it.
  • Do not infringe MindSwap or third-party intellectual property; if you believe your Service infringes, you must notify us immediately.

4. Other Rights and Limitations

4.1 In addition to other prohibitions in these API Terms and the MindSwap Terms of Service, you are prohibited from:
  • Developing or distributing a Service that facilitates criminal, fraudulent, or illegal activity.
  • Selling, renting, leasing, reselling, assigning, or sublicensing rights granted under these API Terms to any third party.
  • Using the API for a Service that constitutes, promotes, or is used in connection with spyware, adware, or other malicious code.
  • Using the API for purposes other than providing clients access to the Partner Service.
  • Disrupting or circumventing our technical processes or security measures, or testing vulnerabilities in our systems.
  • Implementing features or business practices that harm MindSwap's reputation, relationships, or professional ecosystem.
  • Using techniques to hide or distort information that identifies your activity or Service when requesting permission to use the API.

5. API for Personal Use

5.1 When creating an API key, the API User must select the key type "For personal use". This confirms the API User's consent to use the API solely for personal purposes and prohibits commercial use.
5.2 The afftax reward parameter and the refcode reward increase parameter are not available in the /api/v2/price and /api/v2/create methods.

6. API for Commercial Use with Affiliate Program

6.1 When creating an API key, the Partner must select the key type "For commercial use with the affiliate program". This confirms the Partner's consent to use the API solely for commercial purposes and prohibits personal use.
6.2 When applying to use the API with the Affiliate Program, the Partner must provide complete and accurate information about their Service, including the name, link, usage, and other relevant details required to evaluate compliance. MindSwap may contact the Partner by email to clarify details.
6.3 The review period after receiving complete information is three (3) days. During this period, the Partner can use the API key and the afftax parameter, but affiliate accruals begin only after approval. If the application is rejected, accrued funds are canceled.
6.4 For completed exchanges created with the refcode parameter, the Partner receives a reward equal to 40% of MindSwap income from all Qualified transactions. The Partner also has access to the afftax option to increase earnings.
6.5 The Partner must display a clear notice that the exchange is provided by MindSwap and that creating an order confirms agreement with MindSwap rules. Use the following text: "The exchange service is provided by MindSwap. Creating an order confirms your agreement with the rules of MindSwap."
6.6 The Partner must store information about all exchanges made through the MindSwap API and provide complete information upon request from MindSwap or law enforcement agencies.
6.7 The Partner's Service terms must not contradict MindSwap rules. The Partner must ensure its rules remain consistent with MindSwap requirements and prevent actions that could violate or damage MindSwap.
6.8 MindSwap may verify incoming transactions using its security system in accordance with the AML section of the MindSwap Terms of Service. If an exchange is suspended, the Partner must notify the Referral to contact the MindSwap security team at [email protected].

7. API for Commercial Use without Affiliate Program

7.1 When creating an API key, the Partner must select the key type "For commercial use without an affiliate program". This confirms the Partner's consent to use the API solely for commercial purposes and prohibits personal use.
7.2 When applying to use the API without the Affiliate Program, the Partner must provide complete and accurate information about their Service, including the name, link, usage, and other relevant details required to evaluate compliance. MindSwap may contact the Partner by email to clarify details.
7.3 The review period after receiving complete information is three (3) days. During this period, the Partner can use the API key and the afftax parameter. If the application is rejected, accrued funds are canceled.
7.4 The Partner must store information about all exchanges made through the MindSwap API and provide complete information upon request from MindSwap or law enforcement agencies.
7.5 The Partner's Service terms must not contradict MindSwap rules. The Partner must ensure its rules remain consistent with MindSwap requirements and prevent actions that could violate or damage MindSwap.
7.6 MindSwap may verify incoming transactions using its security system in accordance with the AML section of the MindSwap Terms of Service. If an exchange is suspended, the Partner must notify the Referral to contact the MindSwap security team at [email protected].

8. API Calls and Compliance

8.1 MindSwap may set limits on the number of API calls you can make, at its sole discretion and without notice, to maintain service stability. If you exceed limits, MindSwap may moderate your activity or suspend API access. By using the MindSwap API, you agree to these restrictions and will not attempt to circumvent them.

9. Confidentiality

9.1 You acknowledge that you may receive confidential or proprietary information related to the API that is designated as confidential at disclosure or should reasonably be considered confidential, whether or not marked as such ("Confidential Information").
9.2 You may use Confidential Information only as needed to exercise your rights under these API Terms. You must protect Confidential Information from unauthorized access or disclosure in the same manner you protect your own confidential information.

10. Intellectual Property

10.1 The MindSwap API is protected by copyright laws and international treaties, as well as other intellectual property laws and treaties.
10.2 MindSwap or its licensors retain all proprietary rights, including patents, copyrights, trade secrets, trademarks, and other intellectual property rights in the MindSwap API and any corrections, bug fixes, enhancements, updates, or modifications. The license granted hereunder does not confer ownership of the MindSwap API.

11. Disclaimer of Warranties

11.1 THE MINDSWAP API AND DOCUMENTATION ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, ALL WARRANTIES, TERMS, OR CONDITIONS, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, CONFORMITY TO DESCRIPTION, AND NON-INFRINGEMENT, ARE DISCLAIMED.
11.2 No advice or information, whether oral or written, obtained from MindSwap creates any warranty not expressly stated in these API Terms. MindSwap does not warrant that the API or documentation is suitable for Partner use, error-free, uninterrupted, or that defects will be corrected. MindSwap makes no warranty regarding results of using the API or documentation.

12. Limitation of Liabilities

12.1 MindSwap is not liable for damages arising out of use, misuse, or inability to use our API with third-party software, including loss of profits or revenue, business interruption, computer failure, data loss, loss of goodwill, or other direct, indirect, special, exemplary, or consequential damages, even if MindSwap has been advised of the possibility of such damages.

13. Lack of Control over Technical Problems

13.1 You acknowledge that MindSwap does not control any cryptocurrency network and that you accept the risks associated with those networks, including unknown vulnerabilities or protocol changes. MindSwap is not responsible for damages resulting from such risks.

14. Duration and Termination

14.1 Your license to the MindSwap API continues until terminated by either party.
14.2 MindSwap may terminate these API Terms and disable your API access at any time, for any reason, including if you fail to comply. You are liable for damages caused by non-compliance. A waiver of a breach does not waive any subsequent breach.
14.3 Any termination of these API Terms also terminates the licenses granted to you under these Terms.
14.4 Upon termination for any reason, you must stop using the MindSwap API and destroy all adaptations or copies of licensed materials and Confidential Information in your possession, and notify MindSwap.
14.5 MindSwap's rights and your obligations that by their nature should survive termination will continue after termination.

15. Applicable Law

15.1 You and MindSwap agree to litigate disputes arising under these API Terms, except disputes where either party seeks equitable or other relief for alleged unlawful use of copyrights, trademarks, trade names, logos, trade secrets, or patents.
15.2 You and MindSwap agree to notify each other in writing of any dispute within thirty (30) days of its occurrence. Notice to MindSwap must be sent to [email protected].

16. General Information

16.1 These API Terms constitute the entire agreement regarding the MindSwap API and supersede any verbal amendments.
16.2 If there is a conflict between these API Terms and any other agreement you enter into with MindSwap, the terms of that other agreement control.
16.3 Our failure to enforce any provision of these API Terms does not constitute a waiver of our rights.
16.4 By installing, copying, or otherwise using the MindSwap API, you acknowledge that you have read, understood, and agree to be bound by these API Terms.
